It's federal law

— OSHA Sanitation Standard, 29 CFR § 1926.51(a)(1)

OSHA's General Duty Clause requires employers to protect crews from recognized heat hazards, and several states already mandate shaded rest areas on every job site. The same standard requires toilet facilities on every site (29 CFR § 1926.51(c)) — a federal shade-and-rest-break rule is moving through rulemaking now.
Non-compliance penalties can run up to $16,550 per violation.
